Background: My wife left me and is filing for divorce. She took her car which is a marital asset that both of us own. She has since left the state to move in with a friend and I cannot get a hold of her as she will not return my calls. Update: Our current auto coverage is set to expire on 10/17. I have taken out coverage on myself through a different company, set to start on the 17th. As of the 17th she will be uninsured unless she takes out her own policy. Where did I go wrong? A few months back, I backed out of a parking place and stopped, waiting for traffic behind me to resolve itself. While stopped, a large vehicle backed into my driver side door. We both re-parked. The other driver first tried to convince me there was no damage and we should both forget it but after I showed him the damage to my door (his car had almost no damage), we exchanged insurance and personal contact information in a friendly conversation. I reported the damage to my insurance carrier, a large national firm, obtained the required 2 estimates for repair and submitted it, as directed by my carrier and his, to his carrier, a large regional carrier. They informed me he had decided my car was not stopped and so I bore responsibility for his backing his car into me (!), and they therefore were refusing to pay me. My insurance carrier said it was up to me to provide proof my car wasn't moving, regardless of the fact his car backed into mine! I approached the repair firm, and they provided me with photos and offered testimony to state that my car was obviously stopped, based on the damage to the door. I called the individual and said with this information unless he paid the bill in full, I would take him to small claims court. He argued but produced a check for the full amount. A month later, my insurance carrier raised my rate based on this incident and a highway speeding ticket over a year ago. I ended up paying more for my insurance and lost a great deal of time despite both of us being insured. Where did I go wrong?

What should insurance depreciate previous damage to a car after accident?

My car was rear ended while parked in front of my house and insurance has declared it a total loss. We have been going back and forth on the value of the car and have finally gotten them to a value that we agree with but we disagree with how much they are taking off for previous damage to the car. There was a dent to the left fender and a scrape on the right back door, Farmers is saying it would cost $1100 to repair which is close to some of the estimates I have gotten from body shops. But they are not depreciating that value down for a used car. We were going through Safeco as well and they were taking 40% of the cost to make those repairs and deducting it from the value. Does anyone know what is standard practice for deducting previous damage to a value of a car? Thanks for your help!

When I was talking with my insurance agent about how much it would go up, I mentioned that at least the speeding tickets would be leaving soon. She disagreed. Here's the situation. Before I start here, I will say I have never sold a car/transferred insurance in my life until now (I'm 37) and I'm panicking. (Please don't laugh; I am somewhat mentally disabled and have a hard time understanding business side of things). Please bear with me: I have a 2000 Chevrolet Malibu with 178,000 miles on it. Last Friday, my husband's brother decided to give his 2005 Hyundai Elantra (53,000 miles) to us as a free gift. We decided to sell the Malibu to some friends of ours (with whom we have been friends for quite a few years). My friends have already paid us and they have a Bill of Sale and next week we are getting a duplicate of the Chevy title in the mail (because we lost ours), at which time we will transfer. Here is where the confusion begins: My mother-in-law (who is a retired State Farm insurance agent) drew up a Bill of Sale that indicated as its last sentence at the end, Buyer will show proof of liability insurance at the time the car is received (or something like that; I don't have the Bill of Sale in front of me). We saw our friends today to get the Bill of Sale notarized (they already paid for the car; we're just waiting for the title for the Malibu to arrive via mail, as mentioned above). Their insurance agent is about 90 miles away, I find out, and will need pictures of the car. Our friends insist that my mother-in-law is just being a mom since we're new at such a transaction (our friends have owned and sold boats, cars, etc., so they are experienced at this, too), meaning that she's being overcautious by saying they need to present proof of liability insurance at the exact time I give them the keys to the car. So, once I give them the title and the keys, are they responsible for when they get the car insurance? My Hyundai is covered through my insurance agent (my mother-in-law called them and got coverage on it already), but she insists that I am not to get insurance verification on the Hyundai until the friends show proof of their insurance on the Malibu after they get possession of it. Is that correct, or is my mother-in-law just being overcautious? (I would think that once I switch the Malibu title to my friends' name and give them the keys, that would relieve me of any responsibility any longer to the Malibu). Help me, please. I am so confused; I have my mother-in-law telling me one thing, and my friends telling me another. Both sound correct. So would I be right if I did these (in this exact order): 1) switch the title over to their name & give them the keys to the Malibu. 2) call my insurance agent and report that I sold my Malibu, and ask them to type insurance vertification for the Hyundai. (would I have to be present in person for them to type the verification for the Hyundai? Also, would my report of me selling the Malibu mean that they would cancel the insurance on it immediately?) I am sorry this is so lengthy; I tried to explain this the best as I could. I just want to do what is correct in the eyes of the law.

Had my car insurance cancelled. What can I do?

My car insurance company recently cancelled my policy due to unpaid direct debit. Here is what happened. My direct debit didn't get paid on the 8th Jan 2013 due to my bank refusing as I didn't have enough funds. 3 days later I recieved a letter through the post stating they will try again in 7 days. 10 days later they tried again and it said that it successfuly went through. It's now February, I just checked on the MID website and my car is uninsured! I checked my bank account and no payment went out this month, and last month, when the payment did go out succesfully, I notice on the same day the payment went back into my account! I can't phone my insurance company yet as its 6am but I assue they've cancelled it and are wanting me to pay the rest in full. Now, when I take out a new policy, will this effect me? I have been getting quotes already and I can see an option asking ''have you been refused insurance beofre?''. My answer would be no, I haven't. My grandfather, who is 72 years old, needs round-the-clock care that has now exceeded our capabilities. He suffers from pre-existing bad to severe dementia. He's suspicious, falls frequently, very forgetful, suffers from sundowning. He just doesn't know what to do and he even struggles with basic life functions. He also suffers from lymphatic cancer that metastasized to his lung and chest cavity, as well as squamous cell carcinoma that is very resistant to all his previous treatment and has spread to open wounds on his arm. Because all of his lymph nodes were removed, his lymphatic fluid constantly pools in that arm and swells to hugely abnormal size. Therefore he has to wear a sleeve to keep it in place, which is painful for him to put on and is time-consuming for his caregiver. He also is supposed to keep his arm elevated, but refuses because of his dementia. He is mean and hateful at times and insists that we are trying to kill him and is always demanding that his caregiver (my aging and stressed grandmother) remain at his side at all times, or he grows suspicious about her fidelity. He has hallucinations. We moved in with them to help her take care of him, but my school work (homeschooled, mainly to take care of them) and my mother's commute to work have also taken a toll on us. We hated to think about it, but we finally resolved that he belongs as a permanent resident in a home. The biggest problem is the astronomical cost which we can't just chip together , as it was never there in the first place. We did research on nursing home coverage and found out about long term care coverage. We found out some basic things like it is best to purchase at a young age. Unfortunately, my grandmother was never educated on insurance and doesn't possess significant life insurance nor anything like long-term care, and he doesn't qualify for the little help Medicaid offers. Although he suffers from cancer, he has reached the end of his treatment. His cancer was too resistant to all prospective radiation and chemotherapy, and the anti-body treatment that he tried, he had a massive allergic reaction to. He has awful pain all the time and is on a rotated regimen of extra strength ibeproufen and high dosage morphine, with a high grade fentanyl pain patch. So, although cancer plays a part in his insurance qualification in name, apart from being administered his medication and sleeve, his cancer is not the main concern as far as his care/treatment goes. We have had to accept that he is going to die sooner or later and are trying to find the best final preparations. Bentonite clay seems to be drawing out some of the side effects of his radiation (after which his cancer got worse), and so may prolong his life. The short prognosis was 2-9 months. His dementia have become exhausting and endless. There's simply nothing we can do anymore. He's on prescription for Aricept for the dementia and we give him melatonin for the sundowning, which seems to have a calming effect. Sorry for the long piece, but we're all very distressed about this and I felt that I had to give a thorough explanation of his ailments and treatment. Our needs are a long-term stay in a nursing home facility covering skilled care for his dementia, activities of daily living, ect. We also hope that he can be treated with respect and dignity. We need affordable prices like anyone else in the middle class, not astronomical rates. We also need a policy that would either cover pre-existing without penalizing for it or not asking health questions, ect., as my grandfather is obviously in need of care we can't offer him. The only policy we have even brushed upon is Physicians Mutual. We don't know anything about it really, and we don't know where to look for anything else. Everything seems to lead to a dead end online when we need a solution. Any help is greatly appreciated.

Ok so I was involved in a car accident November 10,12, I was at fault because I hit the car in the back, the guy just literally stopped and obviously even if you are right about saying that the other driver stopped too fast for you to stop,when you hit a car in the back (most of the time) you are at fault of the accident.Either way, my insurance paid for his damage ($2,000 worth) and I took my ticket to court,there I only paid for court fees but no points. And if the insurance approves paying ( guessing he has all the medical papers in order) will my rate increase too? Again?? I have full cover in my car, and it also includes medical bills. I had to pay $1000 of deductible in order to fix my and his car so pretty much I don't want to loose more money is just horrible I am 21,full time student with full time job! Hi i've just bought a little suzuki SJ410 jeep 1.0L. the jeep was advertised as a SJ410VB. So i put that into my insuance quote before i got the jeep and it was very cheap 800. Okay so ever since years ago I've known that my grandpa has an account for me and his other grand kids for our first car. There is a limit. Now, I went out and picked out the car I wanted. A 2009 Toyota Corolla. Which I can pick any car, new or used as long as it is below the spending limit. (mine is that I picked) But my aunt, (Who is in charge of the money sorta, but will let me get what I want cuz she has no say) Is trying to convince me to get a used car and spend like max 5,000 on it. Her friend's son's friend is selling his car for 1,000. it has 200,000 miles on it and looks like a piece of crud. Needs new tires.. all that stuff. She thinks I should get this car or another used car because mostly all teens get in an accident when they first start driving (I am 18) but so what? So my quesiton is: Would you spend the full amount on the car you want now? i have been with the same car insurance company ever since i past my test 3 years ago, 2 years ago a neighbour accused me of backing into his car I NEVER, i phoned my car insurance company to notify them there was a claim being made against me just to keep them up to date in case they had a phone call from anyone!, Anyway after weeks of Police investigation i managed to prove i was not involved and no claim was ever made, i thought this had all disappeared but now 2 years later and still with the SAME company they are saying i have lied on my no claims and have told me by letter they no longer wish to insure me, then 5 days later they took there payment from my bank ? i only received the letter this morning (sat) and none of the offices are open until mon, i am so worried they wont reinstate my car insurance ? has anyone else been in the same situation ? and what was the outcome ? ( and they also said in the letter that i would have to pay the outstanding amount on my policy withing 7 days or they will send me to a debt collector ?

Okay, maybe a stupid question, but I need help here to settle an argument. I say that home owner's insurance does NOT cover an air conditioner if it breaks, unless it is tied to a disaster event i.e. lightening strike, fire, etc.. Husband says that you can have it in your policy that insurance company will pay to repair or replace the air conditioner if it just breaks down, as long as it is within the manufacturer's expiration date.

Me, and my father both think that this is just an excuse to not insure a new driver. Should I hire an attorney for this?, I purchased a policy online a few months ago within the first few days that i had this insurance I had a storm and damaged my vehicle (minor) with hail damaged I submitted out a claim, appraiser was sent they covered the loss sent a check to me, now i take it to the bodyshop and try to have it fixed but they need a supplement, they contact insurance co. but insurance co, makes many excuses over this they state I dont have full coverage which I do, and it was verfied with them that i do, the next few weeks pass and then I finally get a call from a manager at the insurance company stating that they mistakenly sent me out a check because I made a false claim report, they said that they can tell by my pictures before policy was bought that vehicle had damaged (which is an excuse of denying supplement) and stated the the adjuster overlooked everything point here is that insurance co, cancelled my policy by stating underwriting issues, so now Im without insurance coverage, the manager also stated she reported this to the texas state but mentioned she could not put a stop payment on the check and that I could still use it to fix the car or cashout the check... I am really dissapointed at how all this was handelled, Im thinking about getting an attorney, I already discussed and this issue with the Insurance company and Im basicly told that I lied about the claim and they end my call... Should I wait to get an attorney or should I just get one and go from there? I believe this is bad faith insurance coverage, What should I do? Are insurance companies to blame for high medical cost?

I know there are other factors such as smokers/obese people, lawsuits, and people who don't pay their bills. But i'm wondering if insurance companies are one of the biggest reasons to blame for the ridiculously high cost of medical services and equipment? The reason I wonder is because the prices of medical care are so ridiculously high, but it seems like doctors can simply charge any price they want, no matter how ridiculous, because the insurance company will simply pay it. Unlike if someone was actually paying out of pocket and would actually say your out of your mind for charging that much, you won't get my business . I mean, seriously, even if doctors charged $70 per hour, thats still a high wage for them, and it wouldn't be too unreasonable for an hour of medical work, yet I hear of doctors performing various simple procedures that take like 5-15 minutes and charging hundreds or possibly thousands of dollars. Same thing with medical equipment. It seems any device classified as a piece of medical equipment sells for 10 times what it should reasonably cost to make it. Any level headed person would say they are insane for charging that much. But insurance companies simply pay it, and pass the cost on to the people. Making it so the people are basically getting ripped off through no choice of their own. And making it so people who don't have insurance simply cannot afford to have any care. PS: Another example of medical equipment. Just look at a hoverround wheelchair I've seen the retail price on those be over $9000, just for a middle class one. For a freaking electric wheelchair, that isn't even very great quality since they break down alot. You can purchase a brand new kia or hyundai car for like $7000-$9000. Ridiculous.

I was told by my car insurance that my car was totaled, and would only be good for parts. It was in a MINOR flood, and I called to have it evaluated. They said water was in the motor, fuse boxes, everything was ruined supposedly. I knew they were lying, because I had my fiance check it all out, and there wasn't a drop in it except for the carpeting. I told them so, and said I wanted the car back to fix it myself, but the adjustor said they already paid my bank for the damage (not even the full amount, they came up with about 45% of the payoff amount, but it was worth what I owed on it). They said if I wanted it back, I would have to give them $2,700 for the car. I said to hell with it, and had to come up with 2,600 to pay off the remaining part of the loan, and then go buy another car. Last year, I seen my car in the next town over. Same vin number, same paint chipped bumper, same fist mark behind the passenger door. I was mad, but blew it off. Then, I seen it on a buy sell trade site and decided to inquire about the details. The guy bought it for $800 and didn't have to fix anything on it except for what I needed to fix before the flood (window regulator, wheel baring, and new tires). He told me he thought I had committed insurance fraud to get a pay out from them. So, I called my old insurance company, and the lady took all my information down and gave me the adjustor's number, the adjustor's supervisor's number, and the fraud department's number. I called the adjustor, left a message, and then filed a claim with the fraud department. They said to expect a call from them next week. What exactly happens in a case like this?? I don't expect a hefty payout or anything, but still, I've never known anyone who had this happen to them, but I do know people who committed insurance fraud. Both my parents and I have gone over me getting a motorcycle instead of a car, and they're fully behind it. As far as my knowledge, insurance costs are a lot less (but more for me since I'm just starting out) monthly payments on it are lower, more MPG, more eco-friendly, less space and I personally prefer it, and use it as year-long transportation since we're moving to Orange County, Calfornia from Las Vegas (where it never snows). My car got wrecked and it was my fault. No other cars were involved. I can't afford to have car payments if my insurance company totals the car. It is fully paid for and I have full coverage. If I make the claim to them, at what percentage of the car's value would the insurance company consider it totaled?

Long story short, the light turned red, the car infront of me short-stopped, I did as well with about 6-8 inches to spare with the car in front, and i got rear-ended in the back causing my momentum to hit the car on the front. the car in front of me and behind me had no damage, while my front bumper has scuffs and the license plate is hanging off. the lady in front was in such a rush, she just left since she said her car was fine and left before i could get a name or her license plate, and the lady behind me claims she never even hit me and was planning to leave, until i forced her to stay by threatening that i'd call the police. She refused to exchange information with me. the police came, and wrote a report, but he was giving me a lot of attitude saying that her car suffered no damage, though my rear license plate was bent. he claimed, whether or not she hit you before or after you hit the front car, i find it hard to believe that her hitting you caused that much damage to your front bumper . I got a generic report on a piece of paper and he told me to pick up the report tomorrow. I'm pretty sure she's not going to file a claim, most likely because she can't speak english. i honestly don't want to deal with filing a report and i'm planning on just buying a new front bumper and installing it myself, but my question is, is my insurance company going to be contacted and will my rates rise? I've never been in an accident before so I don't know how this works. My insurance company is HighPoint and I live in New Jersey.

Oh right lol my query is as follows .. In July 2012 my daughter took out a pay monthly insurance policy with close premium 139 per month which was paid from my bank account every month on time for 12 months. When due for renewal August 2013 the insurance company sent her a quote saying payments were 168 per month! In view of this she decided not to insure her car and didn't use it. Shortly afterwards she receives a letter from close premium saying Hastings insurance could cover her for 100 per month but she never accepted this offer. In September 2013 Hastings took payment from my account so I contacted bank and recalled the payment. She now has a recovery agency acting on behalf of Hastings claiming she owes 400 . I can't see how she owes this money ? Do we have to pay this when we never accepted the policy and close premium passed on my bank details without my knowledge ? ( hope this makes sense)

my car has been involved in an rear end crash and the insurance company of the other party denies some of the damages , that are actually done because of the accident. the auto body shop gave me an estimate of 4 to 5 000 $ . my car doesnot cost that much . the insurance company is offering only 633 $ and disagrees with me to total the car . there was no damage prior to the accident made to the car on the rear end side. they argue that the other car that hit me does not have even a dent then how come my car have this much damages. i know that my car did not had n e damage on the rear before the accidednt. based on the automobile source they think that the actual cash value of the car is 1900 , and they have didcted all other damges , that are not because of an accident. please guide me what i should do in this case.

I currently have around $300k in investments and no debt, and OK coverage from a group policy. Do I really need to buy life insurance?
